1. Agreement to Terms

By downloading, installing, or using the PrankAI mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and PrankAI ("we," "our," or "us") governing your use of the App and any related services.

2. Description of Service

PrankAI is a mobile application that uses artificial intelligence to transform photos into humorous, prank-style content. The App allows users to:

  • Take or select photos from their device
  • Apply various prank templates (e.g., wanted posters, magazine covers, breaking news)
  • Generate AI-powered text and visual modifications
  • Save and share the created content

3. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's permission to use the App and that they have read and agree to these Terms.

4. Account Registration

To use certain features of the App, you may need to create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Keep your account credentials secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

5. Subscriptions and Auto-Renewal

5.1 Premium Subscription

PrankAI offers premium subscription plans that provide enhanced features including increased prank generations, no watermarks, and priority processing. Subscription options include weekly, monthly, and annual plans.

5.2 Auto-Renewal Terms (IMPORTANT)

By subscribing, you agree to the following auto-renewal terms:

  • Payment: Payment will be charged to your Apple ID account at confirmation of purchase.
  • Auto-Renewal: Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
  • Renewal Charge: Your account will be charged for renewal within 24 hours prior to the end of the current period.
  • Managing Subscriptions: You can manage and cancel your subscriptions by going to your App Store account settings after purchase.
  • Free Trials: Any unused portion of a free trial period will be forfeited when you purchase a subscription.

5.3 Credit Packs (One-Time Purchases)

In addition to subscriptions, you may purchase credit packs as one-time purchases:

  • Credit packs are not subscriptions and do not auto-renew
  • Payment will be charged to your Apple ID account at confirmation of purchase
  • Credits do not expire and remain in your account until used
  • Credits are non-refundable except as required by applicable law
  • Credits cannot be transferred between accounts

5.4 Pricing

All prices are displayed in your local currency within the App and are subject to change. Current pricing is always displayed in the App at the time of purchase. Prices may vary by region.

5.5 Promotional Credits

We may offer promotional credits from time to time. Promotional credits are subject to separate terms and conditions as specified in the promotional offer.

6. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Use the App to create content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Create content that infringes on any third party's intellectual property rights
  • Use the App to harass, bully, or harm others
  • Create content involving minors without parental consent
  • Use the App to create content intended to deceive or defraud others
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Use automated means to access or interact with the App
  • Reverse engineer, decompile, or disassemble any part of the App
  • Use the App in any way that could damage, disable, or impair the service

7. Content Guidelines

When creating content with PrankAI, you must ensure that:

  • You have the right to use any photos you submit (either your own photos or with proper consent)
  • The content is intended for entertainment and humorous purposes
  • The content does not violate any laws or regulations
  • The content does not promote violence, discrimination, or illegal activities

Responsible Use: PrankAI is designed for fun and entertainment. We encourage users to ensure that pranks are shared with good intentions and that all parties involved find the content humorous. Please be respectful and considerate of others.

8. Intellectual Property

8.1 Our Intellectual Property

The App, including its original content, features, and functionality, is owned by PrankAI and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our App without our express written consent.

8.2 Your Content

You retain ownership of any photos you submit to the App. By using the App, you grant us a limited, non-exclusive license to process your photos solely for the purpose of providing the prank generation service. This license terminates when processing is complete.

8.3 Generated Content

Content generated by the App using your photos is yours to use, share, and distribute for personal, non-commercial purposes. You may not use generated content for commercial purposes without our written permission.

9. Third-Party Services

The App may use third-party services for functionality such as AI processing, cloud storage, and analytics. These services have their own terms and privacy policies. By using our App, you also agree to comply with applicable third-party terms.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

WE MAKE NO WARRANTIES ABOUT THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF THE CONTENT GENERATED BY THE AI, OR THAT THE RESULTS WILL MEET YOUR EXPECTATIONS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRANKAI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless PrankAI and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or related to:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any third party's rights
  • Any content you create or share using the App

13. Termination

We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination:

  • Your right to use the App will immediately cease
  • Any unused credits in your account will be forfeited
  • We may delete your account and associated data

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms in the App and updating the "Last updated" date. Your continued use of the App after any changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

16. Dispute Resolution

Any disputes arising out of or relating to these Terms or the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Delaware, and the decision of the arbitrator shall be final and binding.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
